Court Denies Motion To Amend Pocasset Park Ruling
Barnstable Superior Court has denied a motion filed by the Pocasset Park Association to amend the court’s judgment on a case involving the purchase and sale of The Park at Pocasset mobile home park.
The association filed the motion in the wake of the court’s December decision that Crown Communities, LLC, a Wyoming-based company that owns and operates a number of mobile home parks across the country, is the rightful buyer of the park. The court filed its decision to deny the motion last Friday, March 10.
The court upheld its ruling in favor of Crown, reiterating the court’s previous finding that the association did not meet the burden of proof to trigger the right of first refusal. The association needed 41 signatures on its petition, representing at least 51 percent of the park’s resident owners. The court found that only 31 signatures on the petition were valid. Evidence failed to prove that the association satisfied the requirements, the court said, by failing to both gather and to verify enough signatures to represent a majority of the park’s resident owners.
